Distance Sales Contract
This Distance Sales Contract applies to orders placed through www.pelcare.nl.
1. Parties

1.2 Buyer
The buyer is the person who places an order through www.pelcare.nl.
Hereinafter referred to as the “Buyer”.
Buyer details are provided by the Buyer during checkout, including name, billing address, delivery address, email address and, where applicable, telephone number.
2. Subject of the Contract
The subject of this Distance Sales Contract is the sale and delivery of the product or products ordered by the Buyer through www.pelcare.nl.
This contract sets out the rights and obligations of the Seller and the Buyer regarding online purchases, payment, delivery, cancellation, withdrawal, returns and refunds.
3. Product Information
The product or products purchased by the Buyer are shown during checkout and in the order confirmation email.
Product information may include:

quantity;
-
product price;
-
VAT, where applicable;
-
shipping costs, where applicable;
-
total order amount;
-
billing address;
-
delivery address;
-
selected payment method;
-
selected delivery method, where available.
The Buyer is responsible for checking the order details before completing the purchase.
4. Prices and Payment
All prices displayed on www.pelcare.nl are in euros and include VAT, unless stated otherwise.
Shipping costs, if applicable, are shown during checkout before the Buyer completes the order.
Payment must be completed using one of the payment methods offered at checkout.
The Seller reserves the right to change prices at any time. Price changes do not affect orders that have already been confirmed by the Seller.
5. Order Confirmation
After placing an order, the Buyer will receive an order confirmation by email.
The sales agreement is formed once the order has been accepted and confirmed by the Seller.
The Seller may refuse or cancel an order if:

the product is unavailable;

payment has not been completed or verified;

the order information is incorrect or incomplete;

there is an obvious error in the product information or price;

fraud, misuse or unauthorised activity is suspected;

delivery to the requested address is not possible.
If an order is cancelled by the Seller after payment has been made, the Buyer will receive a refund as soon as reasonably possible.
6. Delivery
Orders placed through www.pelcare.nl are shipped from the Netherlands.
The product will be delivered to the delivery address provided by the Buyer during checkout.
Estimated delivery times may vary depending on the destination, carrier, public holidays, order volume and circumstances outside the Seller’s control.
Estimated delivery times are generally:
Netherlands: 1–3 business days
Belgium: 2–4 business days
Germany: 2–5 business days
Other EU countries: 3–7 business days
Delivery times are estimates only and are not guaranteed.
The Buyer is responsible for providing a complete and correct delivery address. The Seller is not responsible for delays or failed delivery caused by incorrect or incomplete address information provided by the Buyer.
7. Shipping Costs
Shipping costs, if applicable, are displayed during checkout before the Buyer completes the order.
From time to time, the Seller may offer free shipping promotions. Such promotions may be subject to minimum order values, destination restrictions or other conditions.
8. Right of Withdrawal
If the Buyer is a consumer located in the European Union, the Buyer generally has the right to withdraw from the purchase within 14 days after receiving the order, without giving any reason.
To exercise the right of withdrawal, the Buyer must inform the Seller clearly by email before the withdrawal period expires.

9. Return Conditions
Products can only be returned if they are:

unused;

unopened;

undamaged;
-
in their original packaging;

returned with all included items, where applicable;

accompanied by the original invoice or proof of purchase.
For hygiene and safety reasons, skincare and cosmetic products that have been opened, used, unsealed or damaged after delivery cannot be returned, unless the product is defective or incorrectly delivered.
Returned products will be inspected by the Seller.
Products that are not in a condition suitable for return may be refused. In such cases, the product may be sent back to the Buyer.
10. Return Shipping Costs
For returns of non-defective products, return shipping costs are the responsibility of the Buyer.
If the product is defective or incorrectly delivered by the Seller, the Seller will review the case and provide an appropriate solution, which may include replacement, refund or reimbursement of reasonable return shipping costs.
The Buyer is responsible for the return shipment until the product reaches the Seller. The Seller recommends using a trackable shipping method.
11. Refunds
Once the returned product has been received and inspected, the Seller will inform the Buyer whether the return has been accepted.
If the return is accepted, the eligible amount will be refunded using the original payment method, unless otherwise agreed.
The Seller may withhold the refund until the returned product has been received or until the Buyer provides proof that the product has been returned.
12. Exchanges and Store Credit
If the Buyer prefers, the Buyer may request an exchange or store credit instead of a refund, subject to product availability and approval by the Seller.
If the replacement product has a higher value than the returned product, the Buyer must pay the price difference and any applicable shipping costs before the replacement product is shipped.
If the replacement product has a lower value, the Seller may provide store credit or refund the difference, depending on the situation and applicable law.
13. Damaged, Incorrect or Defective Products
If the Buyer receives a damaged, incorrect or defective product, the Buyer should contact the Seller as soon as possible after delivery.
The Buyer should email info@pelcare.nl and include:

a clear description of the issue;

photos of the product;
-
photos of the packaging, where relevant.
If the issue is confirmed, the Seller may offer a replacement, refund or another suitable solution.
14. Order Cancellation
If the Buyer wishes to cancel an order, the Buyer should contact the Seller as soon as possible at info@pelcare.nl.
Orders can only be cancelled if they have not yet been processed or shipped.
If the order has already been shipped, the Buyer may still be able to return the product after delivery in accordance with this Distance Sales Contract and the Return and Refund Policy.
15. Product Use
The products sold on www.pelcare.nl are intended for external use only, unless clearly stated otherwise.
The Buyer should read the product instructions, ingredient list and warnings before use.
If irritation occurs, the Buyer should discontinue use immediately and consult a qualified healthcare professional if necessary.
The Seller is not responsible for damage, irritation or adverse reactions caused by misuse, incorrect use, allergies, sensitivities or failure to follow product instructions.
16. Allergies and Sensitivities
The Buyer is responsible for checking the ingredient list before using a product, especially in case of known allergies, sensitive skin, pregnancy, breastfeeding, medical conditions or ongoing skin treatments.
If the Buyer is unsure whether a product is suitable, the Buyer should consult a qualified healthcare professional before use.
17. Promotions, Gifts and Samples
Promotions, gifts, samples and discount codes are subject to availability and may be changed, limited or withdrawn at any time.
Free gifts and samples cannot be exchanged for cash.
Discount codes may not be combined with other offers unless clearly stated.
18. Privacy and Personal Data
The Seller processes personal data in accordance with the Privacy Policy published on www.pelcare.nl.

19. Applicable Law
This Distance Sales Contract is governed by the laws of the Netherlands.
If the Buyer is a consumer, this does not affect any mandatory consumer protection rights the Buyer may have under the laws of the Buyer’s country of residence.
